Terms of use for the LECARE Helpdesk & the Community

1. General

The LECARE Helpdesk & the Community (“Customer Portal”) on https://helpdesk.lecare.com is operated by LECARE Gesellschaft für Softwareentwicklung mbH, Goernestraße 27, 20249 Hamburg (LECARE). LECARE is the producer of the LECARE software to support the processes in legal departments. These Terms of Use govern the use of the Customer Portal by users of the LECARE software (Users). Users are employees of LECARE customers.

2. Services and functions of the customer portal

The offer of the customer portal includes the possibility to exchange information with other users about the LECARE software, to share best practices and to post ideas and feature requests for the LECARE software. It is a free offer from LECARE whose use by customers of the LECARE software is voluntary. Lecare is entitled to discontinue the operation of the customer portal in whole or in part at any time.

2.1 Registration, password

Users may register for the customer portal by providing a . an e-mail address and a password of their choice. Users may not impersonate other persons or persons who do not exist. There is no entitlement to registration. LECARE may refuse registration of a user or block access of individual users at any time without giving reasons (if necessary also only temporarily) (e.g. in the event of a violation of section 4 of these Terms of Use).
The user is obliged to choose a strong and secure password. The password must be kept secret. If unauthorized third parties may have gained knowledge of the password, the password must be changed immediately. If the Customer Portal is used by third parties using the password, the User shall be subject to the same obligations as in the case of own use, unless the User is not responsible for the use by third parties.

3. Use by minors

Users may only use the customer portal if they have reached the age of 18.

4. No abuse, manipulation, decompilation

When using the Customer Portal, users must not circumvent any technical security measures or use or execute any equipment or applications that could lead to damage, compromise of data of LECARE or other users or any other malfunction or failure of the Customer Portal.
Users may not use the customer portal to transmit or publish (post) any content in any form (text, images, files, etc.) that is punishable or contra bonos mores. When using the customer portal, no personal rights of other users may be violated. Furthermore, the customer portal may not be used for advertising or other commercial purposes.

5. Property rights and copyright

By offering the customer portal, LECARE does not grant any license or other right to use the protected name, trademark or other copyrights or property rights of LECARE.
The user may not transfer or disclose to third parties the information and documentation made available via the customer portal by LECARE or other users, either for a fee or free of charge, either in full or in excerpts, unless it is expressly stated in the customer portal that content is intended for publication or transfer to third parties.
All rights to ideas and function requests published by a user in the customer portal shall become the sole and irrevocable property of LECARE upon their creation. The user irrevocably grants LECARE the exclusive, transferable, sublicensable, spatially, content-wise and temporally unrestricted right of use and exploitation in all forms of use and exploitation

6. Warranty and disclaimer

From time to time, service interruptions are possible due to software updates and other maintenance work. LECARE accepts no liability for interruptions in the availability of the customer portal. LECARE also assumes no liability for the completeness and accuracy of the content posted by users.
LECARE shall not be liable for any damage resulting from a login being secured with an insecure or unsuitable password, or from the password not having been stored securely and unauthorized persons gaining access to the customer portal as a result.
Furthermore, LECARE shall only be liable for intent and in other cases in which LECARE has mandatory liability by law. Any further liability on the part of LECARE is excluded.

8. Amendment of these Terms of Use

These Terms of Use may be amended on an ongoing basis to reflect legal and technical developments. The latest and most up-to-date version of these Terms of Use can always be found in the customer portal at https://www.lecare.com/support/helpdesk/.
